Terms and Conditions

Ownership

The copyright of all Raw Footage, video files, audio files and edited video files remain the property of Shak Studios until full payment for services has been received. Where services remain unpaid or in the event that a final agreed payment is not made, Shak Studios reserves the right to withhold all files and finished works from the client and maintains the right to use these works for display, promotional or commercial purposes. Copyright in all video, images, audio, lyrics or musical composition included or recorded in the edited video or recorded by equipment used by Shak Studios will remain the property of the author or legal entity and may be used for display, promotional or commercial purposes by Shak Studios.

Sub-Contracting/Vendors

Shak Studios reserves the right to sub-contract any Services that Shak Studios has agreed to perform for the Customer as it sees fit.

Shak Studios does not take responsibility for any intellectual property or copyright breach caused by a Sub-Contractor or Vendor. This includes, but is not limited to, music, graphical asset & video template vendors.

Distribution & Delivery

All edited video & photo files, be they drafts or final versions are shared with the client through a cloud based file sharing platform. The client will receive a URL link which they can use to download the files.

Please note that this URL link will expire after 30 days. Retrieval of Edited video & photo files after expiry date may incur an admin fee of $50.00 + GST invoiced to customer on the provision that the file is still available on the cloud storage system.

If you wish for the final product to be delivered to you on a USB additional charges will be incurred.

Retrieval of Raw Footage

The Customer can request for the collection of Raw Footage, within the 30 days following the last payable invoice, provided no force majeure has occurred. This retrieval is free of charge assuming the customer provides appropriate media be that of a USB or Hard-drive (depending on file sizes & format criteria) delivered to Shak Studios’ postal address including return prepaid envelope to send the media back to customer.

After the 30 days period, the Customer can request for Raw Footage, assuming the footage is still available, not disposed of and no force majeure has occurred, for an additional recovery fee.

The customer will be charges $150 + GST as a recovery charge fee in addition to below:

  • The customer will also provide suitable media be that of a USB or Hard-drive (depending on file sizes & format criteria) delivered to Shak Studios’ postal address including return prepaid envelope to send the media back to customer.

Or

  • The Customer will be invoiced for any cost incurred such as supply of an appropriate storage media and postage, etc.


 Disposal

All raw video & photographic footage, video files, audio files and edited video files will be retained for a period up to three (3) months.

At the end of three (3) months, Shak Studios reserves the right to dispose of all raw video & photographic footage, video files, audio files, edited video files, and recorded materials.

Force Majeure

In the case of Raw Footage, video files, audio files and edited video files being unobtainable due to a fire, flood, storm, earthquake, explosion, sabotage, corruption of files or an ‘act of God’ taking place within the three (3) months following the last payable invoice; Shak Studios takes no responsibility for any liability associated to the files.

Cancellation

  • Any cancellation prior to a shoot commencement will attract 50% of all relevant costs to the day’s shoot.
  • Cancellations on the day itself will incur 100% of all costs of the scheduled shoot.

Cancellation charges are subject to Shak Studios’ discretion and dependent on circumstances.
